Harris County Attorney Abbie Kamin Sues to Bring Hawthorn Park Landfill into Compliance

HOUSTON – Harris County Attorney Abbie Kamin has filed a lawsuit against the operators of a local landfill that threatens the neighborhood surrounding it with dangerous pollutants. The suit is against USA Waste of Texas Landfills, Inc., a subsidiary of Waste Management, who operates the Hawthorn Park Landfill in the Carverdale area.

At a press conference Tuesday, surround by neighborhood residents who have been advocating for years, Kamin outlined a storied history of the landfill’s lack of transparency regarding pollutants, including methane and volatile organic compounds (VOCs) that can seep into the groundwater. Residents in the historically Black and Hispanic neighborhood have complained for years of flooding, noxious smells, and other quality of life concerns they link to the landfill. Harris County Pollution Control has never been allowed access to the property for independent testing.

“The Hawthorn Park landfill has plagued this neighborhood for nearly 50 years, including 20 years of elevated methane readings that are dangerous. We’re seeking to shut this landfill down once and for all, for the sake of residents and future generations,” said Kamin. “This neighborhood should not be known for its landfill, it should be known for the proud spirit of Carverdale residents.”

The lawsuit also identifies concerns about contaminated groundwater where chemicals including chlorobenzene, arsenic, and barium have been found. The aquifer under the landfill is a source of drinking water. The Environmental Protection Agency (EPA) reports that prolonged exposure to these chemicals through drinking water can be associated with skin damage or problems with the circulatory system, including increased blood pressure, and may lead to an increased risk of getting cancer.

“We believe they’re processing just enough debris here to keep it open to avoid having to disclose what’s happening inside the fence line. To put it simply – the string of excuses by Waste Management is not lining up with the facts,” added Kamin.

Kamin also thanked Council Member Amy Peck, who represents the area, for her advocacy as all levels of government continue to work to bring reprieve for neighbors.

Harris County has previously succeeded in efforts to stop Waste Management from expanding the landfill and its operational permit. In 2023, amid public pressure, the company withdrew its request to expand after an Administrative Law Judge granted a motion to conduct soil and water testing at the site.
